The seller considered that the terms of sale under the agreement regarding their liability for the payment of the agent`s commissions are not clear and that the agent has not fully fulfilled his obligations under the 2013 Consumer Contracts (Information, Cancellation and Additional Charges). The seller notified his 21-day notice on May 16, 2017 and the representative confirmed that the exclusive representation rights would expire on June 6. On May 23, however, the seller informed the broker that he had accepted an offer through another real estate agent. The real estate agent then sent the seller an invoice for his fees. Since the seller did not ask questions of the agent and did not adjourn the agreement within the cooling-off period, the Ombudsman considered it fair and reasonable for the agent to have considered that the seller understood the conditions and that he wished to continue to order them. In the event that the tenant does not pay the rent on the due date, RPM sends a waste letter about seven days after the rent due, with another letter after a fortnight/twenty days. If the rent is not yet paid before the next payment expires, notice is notified for rent arrears. If the rent is not yet paid when the notice period expires, the case will be turned over to a collection office as soon as possible. The cost of the collection office collection procedure will be added to the balance owed by the tenant. Regardless of the above, RPM is also prepared to hire the lessor`s lawyer at that time, if the owner confirms it and if the owner is responsible for the costs to be paid directly to the law firm thus mandated. The terms of sale of the agent clearly stated how the agreement could be terminated and the effect that a cancellation of the agreement would have on the seller`s liability to the commission.
PMRs are the exclusive owners from the date of this agreement, which can be terminated in writing on the terms. In the event that Express Let Limited`s contract is terminated for the duration of the lease, Express Let Limited will make 30 days` notice available to the landlord/tenant to cancel the contract.
